Consequences of Perry v. Schwarzenegger

If the courts rule for the defense in this case, it would mean that states can ban marriages that do not provide what voters consider the ideal environment for child-rearing. It would mean that – if voters or representatives agreed – bans of nuptials for ex-convicts, smokers, the clinically depressed or (potentially) those with poor genetics could be constitutional.
